Privacy Policy

This policy explains how NUWA Technology Pty Ltd handles personal information for the NUWA marketplace app, our restaurant commerce services and this website.

1. Scope

NUWA Technology Pty Ltd ("NUWA", "we", "us" or "our") provides technology for restaurants, including the NUWA marketplace app, ordering, payments, booking, loyalty, customer engagement and operational dashboard services.

This policy applies when you use the NUWA marketplace app, place an order through a participating venue, interact with a NUWA-powered restaurant service, contact us, or visit our website.

Participating restaurants may also have their own privacy practices. Where a venue independently collects or uses your information, its own policy may also apply.

2. Information We Collect

The information we collect depends on how you use NUWA. We aim to collect only what we need to provide and improve the service.

3. How We Use Information

We use personal information to:

  • create and manage user accounts;
  • process orders, bookings, payments, refunds, delivery and venue communications;
  • show nearby or relevant restaurants, menus, offers and loyalty features;
  • send service messages, receipts, order updates and support responses;
  • operate, secure, debug and improve NUWA products;
  • detect fraud, misuse, service errors and security incidents;
  • send marketing communications where permitted, with an unsubscribe or opt-out option; and
  • meet legal, tax, accounting and regulatory obligations.

4. When We Share Information

We do not sell personal information. We share information only where needed to provide, operate, protect or improve NUWA services.

  • Participating venues: order, booking, customer and fulfilment details needed to serve you.
  • Payment processors: payment, refund, fraud prevention and transaction details.
  • Delivery and logistics providers: delivery details needed to complete an order.
  • Technology providers: cloud hosting, authentication, analytics, crash reporting, messaging, customer support and security tools.
  • Professional and legal advisers: where needed for business, compliance, dispute or legal purposes.
  • Authorities: where required or permitted by law.

Some providers may process information outside Australia. Where this happens, we take reasonable steps to use providers that protect information consistently with this policy.

5. Security and Retention

We use administrative, technical and organisational safeguards designed to protect personal information from misuse, interference, loss, unauthorised access, modification and disclosure.

We retain personal information only for as long as reasonably needed for the purposes described in this policy, including to provide the service, maintain business records, resolve disputes, prevent fraud, comply with legal obligations and enforce agreements.

When information is no longer needed, we delete it, de-identify it or aggregate it so it no longer identifies you.

6. Data Deletion Policy

You can request deletion of your NUWA marketplace app account and associated personal information at any time.

How to request deletion: email inquiry@nuwa-tech.com.au with the subject "NUWA marketplace app account deletion request" and include the email address or phone number linked to your account. If account deletion is available inside the app, you may also start the request from the app account settings.

After receiving a request, we may need to verify that you control the relevant account before deleting it. Once verified, we will delete or de-identify your account and associated personal information within a reasonable period, unless we need to retain limited information for legitimate reasons.

Information that may be retained after account deletion includes:

  • transaction, tax, refund, chargeback, accounting or audit records required by law or standard business practice;
  • records needed to prevent fraud, protect security, resolve disputes or enforce terms;
  • information already provided to a participating venue where the venue is required to keep its own operational or legal records;
  • backups that are overwritten on normal backup cycles; and
  • de-identified or aggregated information that no longer identifies you.

Deleting your NUWA account does not automatically cancel active orders, bookings, subscriptions or obligations with participating venues. If there are active transactions, we may complete or cancel those transactions before finalising deletion.

If you signed in using Apple, Google or another third-party login provider, deleting your NUWA account deletes your NUWA account data but does not delete your account with that third-party provider.

7. Access, Correction and Choices

You may request access to personal information we hold about you, ask us to correct it, unsubscribe from marketing communications, or withdraw optional permissions such as location access through your device or app settings.

We may need to verify your identity before actioning access, correction or deletion requests.

8. Children

The NUWA marketplace app is not intended for children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided personal information to us, contact us so we can review and delete it where appropriate.

9. Changes to This Policy

We may update this policy from time to time. The updated version will be published on this page with a new effective date. If a change is material, we may provide additional notice through the app, website or email.
